Intent to distribute
"Possession with intent to distribute" (PWID) is a charging theory under 21 U.S.C. § 841(a)(1) and parallel state statutes that elevates simple possession to a distribution-level offense based on circumstantial evidence of an intent to transfer rather than personally consume. Prosecutors infer intent from quantity (amounts exceeding personal-use thresholds), packaging (individually baggied product), cash, scales, ledgers, multiple phones, and the absence of use paraphernalia. PWID carries the same penalty ranges as completed distribution under § 841(b), including mandatory minimums at 100 kg/plants. Biden's December 2023 pardon expressly excluded PWID offenses, leaving thousands of federal cannabis inmates outside the scope of clemency.
