Paraphernalia

Paraphernalia means any equipment, product, or material primarily intended or designed for use in manufacturing, processing, concealing, or ingesting a controlled substance. The federal Drug Paraphernalia Statute, 21 U.S.C. § 863, makes it unlawful to sell, offer for sale, transport, or import drug paraphernalia across state lines; penalties include up to three years imprisonment and forfeiture. State paraphernalia laws (derived from the Model Drug Paraphernalia Act) typically enumerate items such as pipes, bongs, rolling papers, roach clips, grinders, and scales, and courts apply multifactor tests (advertising, location of sale, statements of the seller) to determine intent. Legalization states generally exempt cannabis-related paraphernalia from criminal statutes when used with lawful cannabis, but the federal statute remains on the books; mail-order bong retailers have been prosecuted (e.g., Operation Pipe Dreams, 2003). Paraphernalia possession was historically a common "stop-and-frisk" charge; Maryland Gov.
