MMTC (FL)

A Medical Marijuana Treatment Center (MMTC) is Florida's statutory designation for a vertically integrated business licensed to cultivate, process, and dispense medical cannabis. Codified at Florida Statutes §381.986 following Amendment 2 (2016, 71% approval), MMTCs are the only entities authorized to perform any cannabis commercial activity in the state. The Office of Medical Marijuana Use (OMMU) within the Department of Health licenses and oversees them. Each MMTC must secure sequential authorizations for cultivation, processing, and dispensing, and begin dispensing within 210 days of cultivation approval. Applicants historically had to be a Florida nursery with 30+ continuous years of operation — the notorious "legacy nursery" barrier. The mandatory vertical integration structure was upheld by the Florida Supreme Court in Florigrown v. Department of Health (May 2021), reversing lower courts that called it an "oligopoly." OMMU opened an application window for 22 new MMTC licenses in April 2023. Adult-use Amendment 3 failed in 2024 at the 60% threshold, so Florida remains medical-only.
